Property Damage Question

Hello.

In October we had landscaping done on our backyard. There is a house behind ours, new construction - not sold yet. The front of the property slopes down and our property line is at the base of the slope. The county did not enforce the builder to put measures in place to limit soil erosion from the property. We live in Washington State and when the rain started soil ran off the property wiping out much of the grass that had been seeded and grading that had been done. In addition, soil ran off the hillside and caused damage to our french drain.

We informed the builder about the damage. They moved to Florida and told us they were unaware but they would take care of it.

To make a long story short, the county passed final inspection even though they had not taken care of the hillside. They county had told us to get three estimates of what it would take to fix our property and then dropped the ball on us. We showed the estimates to the builders and they dispute the amount which realistically is about $3000.00. The builder thinks it should be about $1000.00 even though we have shown them estimates to the contrary.

In addition, people just purchased the house and signed the closing papers today. They added an addendum to the closiing papers saying that the builder would be responsible for paying for the damages to our property. We wanted them to pay us out of escrow instead of directly from the builder but they didn't word it that way.

Bottom line, now that the house is sold and the builders still will not agree to an amount is there anything legally that we can do to get the money from the builder to fix our property. Since the amount is under $5,000.00 I am sure an attorney wouldn't find this a worthwhile case.
