What is the name of your state? CA


Is a property owner liable for damages done to a neighbor property from tree roots originating from trees on his property even if he didnt know the roots were doing damage.

I feel my question is very specifc and has never been answered.


Does a owner need to have knowlege his trees are doing damage to a neighbors property to be liable????

last time I asked this I was told to provide facts
What would you like to know?

In thread 306856, seniorjudge gave you an excellent answer, "Yes, that person could be liable." No one understands law, not even lawyers and judges, because it is too complicated. Homeguru played with me when answering my thread and no one else has replied because no one here knows the answer. No one can give you a guarantee that you would win if you sue your neighbor. You have a chance. In small claims court, you're not risking much if you lose. Ask yourself if it is worth it. Only you can answer that question.

I got a response in that thread .....the answeres was
"he could be liable but I dont know the facts".
Well, my response was what do you need to know to make have an educated opinion. You have "Judge" in your user ID. I know that there are no sure things from this site. But I felt that at least for the people that were responsing to the questions would have a clue given the facts on the table or dont respond at all.

Sorry it came to this. I really was hoping and looking for advice not for people like you and the SJ to make people feel stupid. You know what you guys do.
We come he to learn not to be insulted and made to feel small.

If you have information to post on tree roots it would me much appreciated by me and many others if not oh well
