Hi I live in a suburb of Detroit and my girlfriend has a neighbor who has been aggrevating her since he moved into his lower level apartment.

He plays his radio too loud at night, even after the noise oridnance hours of 10pm which states in the lease agreement. Every time we try to confront the guy he talks at the top of his voice and wont let us get a say in, or if we try to talk to him he interrupts us and repeats himself repeatedly.

When we see him outside going to the car or whatever he stares at us and asks us if we want a cigarette or a coffe like nothing is wrong. The last time he came up to say that we were noisy I was blatent and said, "Don't ever come knocking on our door again, we have nothing to say to you," and slammed the door shut.

We've written several letters to the complex reguarding his intolerant behavior and even went as far as threatning a civil suit against them. They done nothing, but they said she can have another apartment in 3 months. Her lease is up in November so moving in 3 months to another aparment in the complex is rediculous considering she is moving out after her lease is up.

Anyways,

Today she had to stay home with her daughter who was throwing up this morning and was sick. She was cleaning her apartment and doing laundry and the neighbor came up to the apartment and started to kick the door and yell profanity names at her.

She picked up the phone and called 911 and an officer came to check it out, by that time he was gone and she took the report.

What are her legal rights as far as filing charges against the neighbor for verbas assults and attempt to break in her apartment?

The complex has agreed to let her break her lease but she has to pay for march rent. However, she is moving out this weekend because she fears for her daugherts and hers life. We feel she should not have to pay for next month rent.

Thanks for any advice on this situation. We want to throw the book at this jerk and

Kris

She will owe march rent .

If she can stick it out ,to end the lease early , She should .

Each and everytime there is a noise or harrasment issue , She should call the Police .
