Auto repair shop used & damaged trk while in for repairs

What is the name of your state? North Carolina

Need help trying to determine our legal rights against a auto repair shop.

Why?

1. They used our truck to do their business runs and some personal driving (484 miles), hauling vehicles, trash, parts, etc without our permission or knowledge. In turn the truck was damaged while they were driving it. Also they let unlicensed drivers do the driving.

2. They threatened us with a mechanics lein if we did not come pay them immediately. We had tried for 3 weeks to get the total of the final bill. We even talked to them the same day they left the mechanics lein message.

3. They charged us $648.00 for work they did not do.

4. When we picked the truck up it would not run. We had to put parts back on it just to get it to start. Then had to take it to another repair shop to have the carberator repaired that they had damaged at a cost of another $140.00. Now we have to find another repair shop to determine just what they did and did not do and get whatever repaired.

Do we have any legal rights or what can we do, please help?

Did you sign or receive an estimate for your repairs? Is this amount over what they stated? Do you have a listing of what labor and parts they repaired/replaced? Have another licensed mechanic verify if indeed these parts were in fact replaced. Do you have proof your vehicle was driven? Most repair shops will log the mileage on their estimate and repair for order forms.

Taking it one step forward with your evidence you may also want to contact DMV. All repair facilities have to be licensed by the state. Ask for the Repair shop complaint phone number or address. Make a complaint.

We did not get the upfront estimate. We are in the process of having another mechanic go over the bill and see what was done and what was not. We already have one bill from a mechanic that states it was the repair shops fault for the damage to the carberator. The mileage on the bill does not match what was actually done - they fudged it. However, we have the mileage of where it was inspected 2 weeks prior to it going to them.
