Can a state government not be responsible for its citizens

What is the name of your state? New Mexico


A company wants to build an uranium enrichment plant in Lea county , New Mexico.
Emissions are carcinogenic,
State Government gave regulatory authority over emissions to the NRC.
State now says they have no authority over emissions,
NRC inspection officials not stationed in the state.

My question- is the State government now not liable for any illnesses this plants emissions will cause?

No. Because they never WERE responsible for any illnesses that the plants emissions cause.

The State Government can legally sign over emission regulation authority to the NRC.?


And if there is a State environmental report that both parties have ignored, dealing with high winds which would accelerate the cancer-causing emissions going over populated areas?
Does that change liability status of the state?

I never said that... but the answer is yes, since there is NO obligation.

Nope. Look up 'governmental immunity'.

The NRC has regulatory authority over all nuclear radiation in this country. With certain states known as "agreement" states the NRC will sometimes turn over the regulation of certain types of low level radiation to the state. New Mexico is one of these states.

I believe that you have your facts backward. It is the NRC which has the power to grant authority to the state, not the other way around. Uranium enrichment programs would probably produce fairly high levels of radiation and I doubt that the NRC would grant authority for it to the state.

emission question

What the state has done has signed over all authority on emission regulation on this plant to the nrc.
State wont even provide a radiation monitor for the schools here. Neither will the nrc.

New question- if the state study for this county indicates the dust levels are high enough to be above the national ambient air quality standards set by the clean air act::
if this plant is allowed to vent on high dust level days, would that be a violation of the clean air act?

The details of the emergency plan for the plant and the public are being kept a secret- the NRC will not release them.

The NRC does not care about you. They see their role as being one of protecting the nuclear industry. For example, where I live they are decommissioning a nuclear power plant and storing the fuel rods (most radioactive substance known to man) where? Why right smack on top of an active earthquake fault of course. The NRC knows this. They were informed of it by Doctor Jelle DeBoer, the world's leading expert on this area's geology. The response? They don't care.

So get used to it.
