What is the name of your state? Alabama
There is an old fence which was put up several years ago (fence is in disrepair), located between my property and my neighbors property. Per legal survey, the fence is on my property, however, my neighbor indicates by "adverse posession" that the property line is the old fence line. I would like to remove the old fence and replace with the new fence onto the legal desciption survey line. My neighbor objects, what is my legal recourse?

Put up a new fence and let him sue you, if he is really that insistent. In other words, call his bluff.

How long has the fence been there? You could possibly file a quiet title action if it has been there some time.
