What is the name of your state? California
I paid 2500.00 for the car, and part of the agreement was that he would repair the transmission.
He never repaired the transmission, and after numerous lies and delays, and a year later, I’ve decided not to take delivery of the vehicle.

My question is..
Can I sue for only monies that I paid him, 1500 check 1000 cash, or should I go after the much higher blue book value?
any other advise as to how to proceed would be appreciated.

Also since I paid 1500.. check and 1000.00 cash, would a witness suffice as for the cash part, since I never got a recipt?

It would help but no guarantees.
