Case is taking place in Kansas where jurisdiction has been established.

The work the plantiff's attorney left a lot to be desired during some PP/visitation issues last year. In fact after the plantiff did investigating after child was finally returned, the plantiff feels as if the attorney put the child in a very dangerous situation.

The plantiff hasn't been able to pay his attorney in full, but has been making regular payments every month.

The plantiff needs to get a tape casette back from the attorney, for future hearings. Is the casette tape the plantiff's personal property, that he should just ask for? Or will the attorney say he can't have it whether he pays the entire bill at once or not?

Plaintiff plans on taking a witness with when he does ask the attorney for the tape.

Plaintiff just wants to be prepared, and know what his legal rights are to get the tape back, before he goes to the attorney's office.

Last year when the plainiff had given the attorney a check for a large retainer, the attorney somehow lost or misplaced the check for almost a month. During that month the attorney didn't do any work on the case. Plaintiff is fearful attorney may have lost, misplaced or destroyed the tape.
