I recently closed on a piece of Property that until 2003 was never Surveyed by Plat.The Land has been in the same ownership since 1962.In 1962 it was Surveyed by metes and bounds,which has never changed..In 1991 two smaller tracts were added in the Warranty Deed,at that time a Son had inherited the Property.In 2003 the Son decided to sell so he had it Surveyed. During the new Survey the Surveyor left off about 155 ft. x 215 ft. section of the Tract.Apparently,after encountering a Highway Monument, he came to the conclusion that there must had been a trade-off of this section of Land with the two smaller tracts with the State,but no Documentation exists showing a Deed.My Surveyor has completed a Survey by metes and bounds from 1962,1986,1991 Warranty Deeds and has concluded that this should super seed the 2003 Survey.Ironically,the County had Taxed the Owner for the Original full Tract plus the two other Tracts until 2003,at which time the 155ft. x 215 ft. section disappeared from the Tax Rolls?The Owner who had inherited the Land, has probably been paying Taxes since 1991, on Property that seemingly disappeared in 2003 after the Survey. If there is no Warranty Deed in 1991 who should own the Land?
