There is no light duty work!!!!!!!

my husband was injured on the job in august of this year. He has had surgery on his wrist and is in the process of recovering. His Dr. now feels that he could return to work to do light duty. He cannot lift over 10lbs and can do absolutely no climbing. This would be okay if he did not work in construction. His boss wants him to return to work but cannot guarantee a 40 hr workweek. He would end up making less than what he recieves from workers compensation right now. We have 2 young children and cannot afford him to make any less than what he is getting now. Does he have to return to work or are there any laws in north carolina that can help us with this situation??

Contact a Workers Comp Attorney, I believe, not positive about this though, that he should be able to recieve the difference in what he isnt able to make from regular f/t employment thru the WC insurance. They should have to pay the difference.

Just as when he is returned to full employment if there is any type of disability still evident he will get a MMI rating, a Maximum Medical Improvement rating and at that time if he has a percentage of disability if he is unable to work for any period of time he is eligible to receive benefits just as if he has to change the type of work he did prior to the injury and has to work at a job for less pay.
