indiana separation

I live in Indiana and moved to St. joe county on the 3rd of november of 2000 and i know i cant file for a divorce or separation for 3 months but he can. Do we have to be legally separated before we can file for a divorce? i plan to file then get a lawyer because of the situation i am in. i am pregnant with another mans child and need to be file asap so my soon to be ex's name isnt on the birth cert. Can i do this? can we even file with out having a lawyer in this situation?? shymama
