The weekend of 5/13, my family and I (spouse, Stepson 17 & 10-month old daughter) moved into an aprt, we didn't sign a lease. It was raining and floods happened the entire weekend. 2 bedrooms are located in the basement along w/ the laundry room and the hotwater heater went - flooding the enitire basement and bedrooms. Took the landlord a week to remove the wet carpets (after having them cleaned 2x) and had the carpet cleanter spay the interior of the walls with mold killer. We all slept in the family room for 2 weeks, couldn't unload the U-Haul as we had no where to put our stuff; mold came back, had carpets put back in after 2 weeks and mold is worse than ever. We did not pay June rent as they're un-liveable conditions but we have no where else to go, Landlord's telling us to leave then he'll take care of removing the mold. Told us we can't live there for free but we said when he removes the mold, we'll pay rent; we are going to give him at lease half month rent for now. We have an infant and he doesn't care. Landlord told us he was having the place inspected on Mon, we were there and he only had an insurance adjuster come by - not someone to inspect the mold. He's looking to get this written off by blaming it on the hotwater heater leaking when it was also all the rain. Mold is starting to eat away at the walls, etc.
Do we have any rights? He said he's doesn't have to have a company remove the mold, the state of NH says that he can do it if it's done the right way and all documented but he's telling us we have to leave the apratment, again getting us to move out. This has been going on for almost a month.
