What is the name of your state? -California

When a new home is purchased through a builder and in the contract it states you can not sell or rent the property until 12 months after closing, can the builder enforce that part of the contract? Isn't there some law that says you can not prohibit a sale because it would be a restraint of trade?What is the name of your state?

A: Yes.

A: No because you can sell it after 12 months.
