I live in Tenn and my husband and i have been married for just over a year, we seperated after 8 months of marriage. I took an order of protection out against him because of the abuse, i have attended Domestic Violence counseling and was given permission from the courts to return to our place of residence with a police escort to collect my personal belongs. when we got there he had the locks changed so i couldn't get in with out breaking in. I have went back to the judge and told him this and he told me he doesn't have to let me have anything until the divorce. I have filled for divorce thru Legal Aid here and this will take a few months. Currently he has another woman living in our place of residence and refuses to give me my belongings. The only property that i want i owned previous to our marriage and a computer that is in my name. is there a quicker way to force him to give my my belongings and does my order of protection protect all of my belongings in the house until i can get him to give them to me?
thanks

My response:

Unfortunately, no.

The judge is correct. Until there is a hearing concerning all marital and non-marital assets, you'll have to wait your turn along with everyone else that's trying to get their divorce.
