My friend has been married for 30 yrs. He wants a divorce. The past 6 years they have barely talked to each other. She lives in the house. he lives in his shop. After telling her she quit her job. Then she refused to live the house. So he moved. Two days later he received foreclosure papers on the house and property. He makes good money, she works 4 hrs a day. He gave her is paychecks to pay the bills, but they weren't getting paid. He had to go and pay all the ultilites and remorgage the house. They paid 69,000 for it 18 yrs ago, now it appraised at 160,000. She told him she wanted half. He borrowed enough to pay old note and 40,000. to give to her. She just now has vacated the property after going on vacation for 2 years. She has played like the victim. She ran off to texas, not packing a single box. He has done it. She calls him constantly demanding something, or just to cuss him. After getting every thing paid, he barely had 100.00 left. So it kills him to think about paying for a attorney.
Now she tells him that she will file that she has been researching it on the internet. She tells him will ask for every thing....What can he do? Did he screw him self by giving her the money?

A normal property division would consist of each party being entitled to half of the assets, and each party being responsible for 1/2 of the debts.

Therefore whether or not he hurt himself depends on on how everything would calculate out. If 40k doesn't equal her half of the assets minus her half of the debts....then he may have to give her more....if its more than her half of the assets minus her half of the debts...then he may have given her too much.

Assets includes the house, cars, any stocks and bonds, retirement accounts, cash in the bank etc. Debts include all debts no matter whose name they are in. He should do a joint net worth statement to see exactly how it all calculates out.

After 30 years of marriage its also quite possible that he is going to have to pay some alimony.

What does the length of the marriage have to do with anything other than guaranteed alimony for the wife???

I agree. After all, wasn't HE ALSO married 30 years? Merely being female and married a long time should be irrelevant, as BOTH have a lot of years invested in the marriage. ONLY time away from the workforce/potential income etc. should matter.
