What is the statute of limitations for filing a malpractice suit against my lawyer? We filed a civil lawsuit in 5/02. Our attoryney did not advise us of a motion for summary judgement filed by the defendants. We lost the motion and realized later that the material facts of our case was not included in the resistance brief by our attorney. We naturally appealed the decision but did not realize again that no new facts could be added to the appeal. We lost the appeal.in 11/04. We cannot get a response from this attorney nor any accounting of the $7,000 we paid for their services. Can anyone advise the statute?

When engaging an enemy, you want to do it on your own terms at a place of your own choosing. We clearly start at a loss when we take on lawyers in court.

file a civil suit against the attorney in question, file a compaint with the state bar, and claim the date of discovery of the error as extending the SOL. Good Luck.
