What is the name of your state? Florida

I am going to leave my husband and i want to leave the house to be closer to my family since i cannot leave and live around where i live since i do not have family up here. Now if i were to leave me cheating husband, with us having children what should i do? I i got up and left how far can i go before its considered kidnapping? should i file for seperation and leave the papers when i leave give me any advice?

You are married. You can take the kids. he can file in Florida to have you bring back the kids and the kids must be returned or you will be in trouble for contempt of court/parental interference/kidnapping. If you file in Florida the kids will not be allowed to be removed from the Court's jurisdiction. If you do move to where your family is it will take six months at least to establish residency during which at any time your husband can file in Florida and force the children back.

Florida doesn't have any legal seperation statutes, so if you file it'll have to be a divorce.
