What is the name of your state? CALIFORNIA

I was in an accident where the other person was at fault. I had just started a new lpolicy, and my previous policy had not expired. The otehr person had no insurance. Can I use both the uninsured motorist policies to pay for my damages?

Sure. But each company is only going to pay a portion of the total. So, for example, if you had UM at 15k/30k on both policies, then they would each pay 50% of the final offer.
