You'll need to find out from an attorney in your state how it works there, and how it works with YOUR builder's insurance. Ask if insurance will not cover willful acts such as fraud, o will it only cover "mistakes" and "events." If you are just now formulating your strategy you may want to find out if it'd be smarter to push for "negligence" which may be more likely to be covered by insurance, and is easier to prove. Proving actual fraud can be very hard. The benefit to proving fraud IMO is if you've got a real bad actor who should be criminally prosecuted. If you have a solid fraud case go to your state attorney general. But you may or may not get much, monetarily, even if your state prosecutes and wins a fraud case. I bet anyone reading here, in your area, considering buying a new home, would love to know who the builder is that has spurred the question.
