How long does an insurance company have to notify you of the amount you are responsible for if you did not have insurance at time of accident? My girlfriend was t-bones by a Ford F-250 at slow speeds (coming out of stop sign) in October 2005. It was registered as her being at fault, and her insurance company had cancelled her coverage without notification. The other drivers insurance company sent her a bill stating there was over $14,000 dollars worth of damages she was responsible for; however, it took them almost 5 months to notify her that she owed them for the damages (March 2006). We have now been waiting for an additional 5 months for them to get back to us on the amount and what needs to be done as far as paying it off, this only after threatening legal action for them not responding to ANY phone calls during this 5 month time frame (from March-August). What, if any, legal rights does she have? Can she ask for a copy of the estimate (as I find it near impossible to believe a '06 Toyota Corolla could do that much damage to a Ford F-250 at slow speeds)? Also, is there no time frame wherein a claim must be sent, or do the insurance companies have the leisure of doing this whenever they please? Any help would be GREATLY appreciated!
