Thanks for replying, one more question please

Thanks to HomeGuru and LegalBeagle for their replies to "Can these people be made to pay me back?" Unfortunately all the loans were cash with only verbal agreements except for the two I obtained IOUs for. However, I read with interest Jennifer H's reply to ShiNaNae in "Lended money" about writing the letter for documentation before the law suit is filed. Would this be helpful to me? Also, there are a couple people that knew about the loans I made at the time I made them, would these people be helpful to my case? I mean as some kind of proof that I made the loans because I spoke to them about it at the time? I guess that's more than one question, but I need all the help I can get!

Though I was not involved in your other post, I offer the following:

1) Sending the debtor a 'declaratory letter' (in which you detail your facts and ask that they advise within a specific period if they dispute them), can be helpful in showing the court that your version of the facts has more validity than theirs. It is by no means as good as a written agreement would have been, but can still help you.

2) You say that you have other possible witnesses to offer "as some kind of proof that I made the loans because I spoke to them about it at the time". Regretfully, these will be of little help... UNLESS they heard the other party agree to the issues. Otherwise they can only testify as to YOUR version of the case, which is already in dispute.
