I was diagnosed with Narcolepsy and Sleep Apnea recently. Due to my illness I have had several tardies, and have fallen asleep on the job. My employer was aware of this and had my apply for a FMLA, but was denied. Before they asked to see why I was denied, they terminated me. Now, the reason for denial was because my doctor failed to date the document, and there was no discription of narcolepsy.
They said doctots fill out these papers everyday, and
apparently he did not see that my tardies were due to my illness. When I told my Dr. this he could not believe they terminated me. In the denial letter it states " I may resubmit my papers to them for the leave. I explained to my employer that there was a letter being sent to them about the hours I worked (accommodations), but all they could tell me was you've been denied for a leave of absence.
I did not ask for the leave, it was given to me so my tardies would be under one occurence. Please help me to point me in the right direction.!!???
