Deconstruction of home w/out City's Final prroval of Plans

My mother who is is 73 years old, signed a contract to remodel her home to add a second story. She found a contractor and had plans drawn in March 2006. In May they started decontruction of her home without having the City's final approval of plans.

She was told to move out as they completely demolished her house to the foundation in July. The City has since made changes to the plans including foundation and how the 2nd story walls are placed. As of now we still have no walls, and they are just now starting the foundation work.

The contractor is now revising his original bid to include the delay's, the revising of the plans and the new foundation work. Was this legal of him to demolish my mom's house when they did not have final City aap-proval of plans?
