vs.

xxx Case No. xx-K-06-xxxxx

DISCOVERY
REQUEST

Pursuant to Rule xxx. Discovery in xxx court, the defendant in the above entitled matter does hereby request under discovery the following:
 A list of the names and addresses all witnesses for the prosecution.
 The model and serial number of the radar or laser unit used in this case;
 A copy of all records regarding the maintenance and calibration of the radar or laser unit used in this case;
 A copy of each and every certification issued to TFC xxx. MSP ID#xxx involving the use of said radar or laser unit.
 A copy of all of TFC xxx. MSP ID#xxx notes on this case including copies of the front and back of the trooper’s copy of the ticket.
Please note: Rule xxx. Discovery in xxx court uses the imperative, “shall furnish.”
“The party served with the request shall furnish the discovery within ten days after service. “
Obviously the public prosecutor would not violate the law, therefore we will have to interpret a failure to provide the documents requested under discovery as an exercise of discretion and a decision not to prosecute this case.

This request is made on this the xxth day of xx 2006.
