We are a New York Corporation being sued in Small Claims Court by an out of state Corporation. Can a Corporation sue in Small Claims Court in new York State? I thought only individuals could. Also, we are being sued in a city court that is in a different county from where we are located. Last, we wanted to counterclaim but the amount we are going to claim far exceeds the limits of Small Claims Court. We wanted to have the case transferred to an appropriate court but we are being told that we have to sue in the state where the other corporation islocated even though they started the action in our state. Please advaise.
