Bad installation of heat pump

I was wondering if I can get your alls opinion. We recently
had a heat pump installed last year in May. Recently
the heat pump has went out because we found out the
system is set up wrong. Basically we had a 3.5 ton
unit heat pump installed and we kept the old air
handler which was a 2 ton unit. They did the new
refrigerant line and new coils. Whenever he bid this
installation to us, supposidly we asked to go with
doing the installation without the new air handler. We
did not know what using our old air handler mated up
to the new heat pump was going make the compressor in
the heat pump go out. He is telling us, we are
responsible because we did not put a new air handler
in with the system, because we wanted to go the
cheaper route. I argued the fact that how was we
supposed to know that we should have went with a new
air handler, since we know nothing about hvac. So now
we have to put a new air handler in, new duct work to
accomadate it and he wants to cut more air openings in
our ductwork and put a new return in. My question is,
who is right here and who is wrong. I think he is
wrong for not giving us the right system in the first
place, just to save us money. If he would have told us
to do a air handler we would have done it. He also
says that our ductwork should be able to handle a 3.5
ton unit. I found the old air conditioner and air
handler booklet that the old owners kept and we
figured out that the ductwork can only handle 1200
cfm. I have been told by 2 companies that we need to
start over, while the original guy is telling me just
to put a air handler in to match the heat pump and
everything should be fine. What is your opinion and
should we have to pay for this? Or would we have any luck taking him to court to get our money back?
