Second marriage for both parties. We have been married for 17 years now. Husband has children (now over the age of 18). We/I have no children. Husband is (partner) in a small business. There are provision the the business papers that in the event of death, partner buys out the surviving spouse for a set amount and the surviving spouse has no rights in the business. There is no will, however addressing the assets in the marriage. If husband dies without will, do the children inherit or have a legal right to a percentage of assets including vehicles, house, etc.? What does spouse get. Home is in both our names. He does have life insurance naming the boys in the amount of $500,000.
