What is the name of your state? North Carolina.
My wife is a magistrate in the state of North Carolina. According to statue she cannot claim mileage reimbursement for travel related to her job in her county of appointment.

Question 1)
She is required to work 24hr shifts to be on call for the city she is assigned. This can lead up to several 20mile round trips in a 24hr period after her office hours. Are these extra trips tax deductible? Currently we view these trips as part of her normal routine and not tax deductible, because this is a normal job expectation.

Question 2)
She is temporary required to cover another city in her county due to a magistrate retiring. This temporary assignment will last until a new magistrate is hired and trained. This mileage is 40miles round trip and is not her normal job assignment in our opinion. For example in one weekend she traveled over 160 miles to go to this extra city in 4 trips just to spend 5min at the job location. If we log these trips in a notebook should we be able to report these trips and deduct this mileage as a business travel expense?
