What is the name of your state? CA

I plan to claim my 7 year-old newphew as dependend this year since I provide more than 50% support. His dad passed away 2 years ago and her mom does not have any source of income. She's living on her dead husband social security benefit (the benefit for the 4 childen though since she's not qualified yet). The boy is not living with me but we're living close by (5 miles apart). Will that be legitimate? What kind of proof I need to provide? I gave the mom $400 cash each month. Both mom and her children are US citizen.

If he's not a qualified dependend, can I claim the expense as charity?
