What is the name of your state? colorado
concerning a criminal matter in weld county misdemeanor court, does a married or common law spouse have to testify against the other spouse? this is a domestic harrassment case in which we are regretting and desperately seeking the courts dismissal! Thank you for your information and time concerning this matter!

Courts don't usually drop domestic violence and domestic harassment/stalking type cases just because the victim has had a change of heart. In fact, spouses, boyfriends/girlfriends change their minds and request that charges be dismissed so often, that in most states, the laws are written so the state can get a conviction without the testimony of the victim. They will have the testimony of the officers who were on scene, took the report and made the arrest. Which will probably be enough to proceed.

However, as senseless as it may be for a victim to change their mind, it can't hurt to ask the judge to dismiss the charges.
