What is the name of your state? New Mexico

Synopsis:
2003 Bought a California house and moved Dec 2004 due to military reason to NM.
Rented said house for approx. 1 year. Feb 2005 to Nov 2005.
Sold house Feb 2006.

My understanding is: The house would have been eligible for exemption IF we would have sold it after moving. However, since house was used as rental, it's considered a business, therefore not eligible for exemption.

Questions.
Is there anything that could have been done, besides moving back into the house, that would have prevented this tax?

Are Realtor fees deductible?
