What is the name of your state? MA--My fiance's mom passed in 3/06 and named him executor in her will, leaving everyhting to him and his daughter. We found out that when his father passed, they did nothing to take his name off of anything. The attorney said that it would need to go through probate for that as well. It's been 9 months now and this is still not done yet. How long should this take?
Also, the house is a 2-family house that the family has owned for many years. His cousin inherited one side from her mother and lives there. They took out a mortgage several years ago to do windows and siding and she paid off some personal debt. Can he take out an equity loan on the property without her name being on the mortgage?
Also, it's a 2-family, not duplex or condo. How do we go about selling the house once it gets out of probate?
