This arrest happened in Ulster Cty.,NYS. I was arrested for trespass and resisting arrest after a disagreement in a retail store. Owner called 911 after discussion re: money that the owner owed my son. Police officer entered establishment,asked me to leave immediately with him and I declined, asking the officer to please listen to story. Immediately handcuffed on one hand. I was completely taken by surprise and resisted allowing the officer to cuff my other hand.I asserted that I would leave with him and be arrested but that I would not allow myself to be handcuffed.
My first question is... is it true that in order to arrest for a misdemeanor, an officer must witness the crime?In addition ,any comments that respondent feels might be helpful are very appreciated.
