What is the name of your state? New York. Do they have to give a blood test or is the breathalizer all they need for a dwi?

Any or all evidence will be used in the case to prosecute you. Breath alone, or combined with other tests, it matters not. And that's only the breath alcohol content part of the case. There will be other evidence.
