What is the name of your state? New York. I read the law but don't understand the difference.

Not sure in your state specifically but in some dui is driving under the influence and dwi is driving while intoxicated.

dui is >.o2 but <.o8 and dwi is .08 and above.

Michigan uses OWI (operating while intixicated) and impaired driving.

DUI in CA is either impaired driving (VC23152(a)) or over (>) .08 BAC (VC23152(b))

The only other terminology in CA is wet and reckless (a lowered DUI - some alcohol was involved).

States differ in their terminology & in a few, there is a lesser charge for DUI among
the terms cited. Some states use only one of those terms.
