I need to know what the labor rates state if a journeyman in contruction started a shift at 12:30 a.m. worked an 8 hour shift has a 6 1/2 hour break then resumes a full 8 hour shift as a employer is this all straight time pay.

Anything over 40 hours in a workweek is considered overtime and must be paid at the rate of time and one-half. Some States have anything over 8 hours in a day. Look up your State's wage and hours law. However, "journeyman" implies that you have a union contract or work out of a hiring hall. If this is so, perhaps you should pose your question to your union rep. or the hiring hall itself.
