My girlfriend was pulled over by a cop last night. The cop simply pulled up behind her and ran her plates(basically, he was fishing) and what came up was a warrant, but what didn't come up was that the case was being appealed. When he came up to her window, she asked if anything that she said would be used against her and she also asked if she was being arrested. The officer called for back-up and asked for her driver's license, not addressing any of her questions. After she gave him her DL, he and other officers then proceeded to push down on her window, reach through the window, unlock and open her door, pull her out by her arm, hand-cuff her, and place her in the back of the squad car! On top of that, her rights were never read! Her mother arrived on the scene, but they would not let her speak to her daughter. At the jail, we spoke to the arresting officer and questioned him, but he only answered a few questions because he did not know any answers. So, he called his superior. He answered more questions, but still insisted that she "...was not under arrest..." but instead she was "...being held..." He then said that she had "volunteered" to go with the officer. Lt. Cop said, while pointing to his badge, that he "...has the right to practice law..." To make a long story short, we got her out. Can anything be done about this? If so, what?
