Hello,

Sister recieved a minor in consumption along with others at a party. She is 18yrs old. This is her first offense and would like to recieve some type of defered adjudacation. Her court date is the same as the other minors. Should she hire a lawyer in order to get a better chance of a defered status? Or should she go in by herself? Main thing is how to avoid getting a misdemeanor.. Thanks for any advice.

She can always go to the first scheduled appearance and see what the prosecutor is offering and/or ask if a deferred adjudication option is available or not. If she doesn't like the answers she receives, she can plead not guilty and then go see about spending money on a lawyer at that time. Just advise her not to discuss the case itself with the prosecutor, simply ask what options are available to her and what is being offered at that time.
