What is the name of your state? IN

My sister was in a serious automobile accident. It was not her fault. She is still off of work after a month with broken foot, broken (smashed bones) hand, and severe bruising from the force of the seatbelt. The car was totaled and they only gave them $1400 for it.

She is getting letters from attorneys that if she wants to sue, she should contact them. Considering that she will have life long problems from the hand injury (she is an office worker and uses the computer at her job ALL day, data input), she may have to seek other employment avenues when she returns to work. The breast/chest area is still bruised and filled with blood and they want her to do a mamo in 3 months (said nothing can be seen till the blood leaves the area).

Should she seek out a lawyer, and if so what percentage of the settlement would they normally get? When should she do this? And what basis would they use to ask for a settlement?

Thanks.

Should she seek out a lawyer
If she is legally ignorant (as implied in your post), yes.

and if so what percentage of the settlement would they normally get?
Depends. Ranges from 30% or so (pre-trial) to 40% or so (if a trial is needed).

When should she do this?
Before the SOL expires.... and before she signs a release.

And what basis would they use to ask for a settlement?
The facts.

She has not signed a release. What are the statue of limitations in Indiana for this type of case?

absolutely get an attorney...any settlement will be limited to the amount of coverage available with regard to the party that caused the auto accident. Attorneys usually take 1/3 of whatever settlement is agreed to.
