if I am sold a product that comes with and warranty and 2 things occur.
1st I was not given a copy of the warranty, if I had been the company would have lost a sale.

2nd there are conditions in the warranty that were not made known to me and without the warranty book the warrranty would have beed voided after just over 2 years rather than 25.

Is this consumer fraud and can I win in small claims court?

If you didn't ask for the warranty book you were foolish. To say you wouldn't have bought if you read the warranty is not realistic either as obviously you did buy it without looking at the warranty.

If the goods were defective you have a legitimate claim. And if you take them to Small Claims court it's a crapshoot.
