My boyfriend was charged with cultivation/manufacturing of a controlled substance with the intent to sell. Here is what happened. The police were sent to his house with a warrant for his arrest due to overdue fines. He was asleep at the time, but the police officers found him as the entered his home. At the time, he had other people staying there in the home with him. He was escorted to his front porch while a second police officer searched the house. Two marijuana seedlings were found in the basement in an obscure location. The plants were not his, and they cannot prove that they are. Also, the conditions of the "plants" were very poor. The two seedlings were under 1 inch tall with no buds or any other actual marijuana on them. He was offered a plea of 2 months in jail with a guilty plea. He is reluctant to accept because he would then have a felony on his record which he does not feel he deserves. We are certain that there are stipulations out there, but we are having a terrible time locating them? Does anyone know of a sit where I could find such a document?
