I, the Plaintiff won a judgement. Now is time to file a 'order and
motion for interrogatories.'

1. The defendant claims she is not receiving alimony (eventhough she
is) and with not include her alimony info in the
order and motion for interrogatories. The closest question to asking
for alimony information is..... Question 11. Have you received any
money judgements from any court within the past 12 months? (She
receives alimony monthly, eventhough the initial judgement for it was
made a few years ago.

What can we do if she does not include this? Should we address
this before having her answer interrogatorie? For example or having
a question added?

2. If we already know that her maintenance checks are the only way to
collect, can we skip the order and motion for interrogatories, and go
ahead and set up garnishment with her husband's attorney, (who handles
the maintenance) If we still need to file the motion, and she does
not give the information, can we go ahead and garnish her alimony if
we already know the information needed?

3. On the, 'Order and motion for interrogatories," It asks for the
judgement amount, court costs, and then what
the total is. We sued Patricia for $645.00 plus $82 in court costs.
The Magistrate miscalculated her math and made the judgement in the
amount of $720, eventhough it shound have been $727.
What should I write on the order and motion for interrogatories? I
don't want the math to not add up, but I want to put what the ruling
indeed was.

It asks for any interest to date... since the Judgement is for $720/727,
should do I add interest from the time of judgement on, or for the
entire time the defendant has owed me money, eventhough the judgement has
already been made on Oct 12'th?

4. It asks for any additional costs....

Can I include any new filing fee's or process serve fees?
Can I include any attorney fee's needed
to get up a garnishment?
Can I include gas mileage to file the papers? (It's a long drive)

5. She has offered $50 a month. I would rather garnish, because her
alimony will run out and then there will be no other way to collect
the full amount. $50 a month will mean I will need to deal with her
for 15 months! She is crazy, and dishonest and I know she won't
follow through.

Thank you and from the heart!
