Netcar sells new cars for the UK market via the Internet.
Jake, Sunesh and Katie are all looking for new cars in the Netcare site.
a) Jake it trying to find an X-type Jaguar “at a sensible price”. There are none available immediately in the website. Jake contacts Netcar and is told that they will guarantee to be able to obtain an X-type within 2 months. Jake agrees to put down a deposit of 50% of the expected price of the car. 3 months later the car has still not been delivered. Jake e-mails Netcar and gives them a further 2 weeks to get the car or return his deposit. At the end of the 2 weeks the car has still not available. Can Jake get his deposit back?

b) Sunesh has bought cars form Netcar previously. He is looking for a new company car. He sees a suitable car, a VW Golf, advertised for £12, 000. He rings Netcar to find out if the car is available immediately. He’s told that it is and as a gesture of good will to a valued customer the Golf could be his for £11,500. Sunesh offered £11,000. The offer was rejected. Sunesh was told that Netcar’s prices were as low as possible and the phone conversation was terminated. Later Sunesh phoned back to say that he now wished to buy the car at £11,500 but was informed that the car has been sold in the interim and that any other models of the same make will not be available at less than £12,250. Advise Sunesh

c) Katie, a dedicated car hunter, was looking for a new Toyota Yaris. The Netcar website had a special offer on the Yaris –“six only. Offers o.n.o £7,000. Bids are accepted online” Katie decided to bid £6,750 for one of the cars via the website but as she pressed the send button there is a power cut that lasts 2 hours. When Katie got back on line, she immediately contacted Netcar. She is told that her bid had not been received and that all the cars have been sold. Does Katie have any remedies available?

Any help with these scenarios will be greatly appreciated.
