Is there any kind of law in VA or anything to back up a car down payment? My aunt put a down payment of $1000 on a used car that the dealership was asking $6900 for. She could not get to the dealership at that time becuase she was in Florida but the lady at the service desk said she could make a down payment and pick it up later and pay the rest. She got a call back from the manager saying they had sold the car on the spot and were refunding her money she put down. She was outraged and said why would you do this and he just said that if he didn't sell the car to the people there he could have been sued for discrimination. We think that they just offered more for the car and he was greedy. Isn't there any kind of agreement with a business like that that says once they debited the $1000 out of the account that the deal had been made? Is there anything she can do? That is just very backstabbing of them

she didn't sign any contract. She gave them a credit card number and they debited out $1000. They said they would hold it for her if she put a downpayment down. if they said they would and took out the money isn't that almost like false advertising or something. I just don't see how you can say okay it's sold and we will hold it for you and take out money from the account and then turn around and sell it someone else.

Exactly my point...

No, it's not false advertising and what you seem to be missing is that the car wasn't sold. Your aunt wanted to give them some money to hold the car that maybe she would pick up, but someone came in and wanted to give them ALL of the money for the car right then. Whether they got $6900 or $10000 for the car doesn't make a difference. They did the right thing and returned the money.
