14 year old child picked up & charged with Possession and consumption of marijuana less than an Oz. No drugs were found on person, no tests done, officer said he did a simple eye test and he could tell he had been using and had used in the past. Parents were call after questioning & were given the Uniform Summons & Complaint form with a Feb 6 date to appear at a Colorado County Court. Does child plead "not guilty" in front of the judge, and then ask for a differed sencence on same charge? Is there a lesser charge, for example just consumption we can plead to?

You are either not telling the whole story or you don't know the law.

If the police report states no drugs found and no positive test, then you go to the judge and plead not guilty and ask for dismissal based on lack of probable cause. You only ask for deferred judgment or lesser sentence when they found something and this is your first time getting caught.
