What is the name of your state? Indiana. A couple gets married in September of 2007. In January a letter comes stating that the husband hasn’t been paying on a judgment from a previous debt that he was ordered to start paying on in August 07. He is ordered to appear in court in Feb for this judgment.

Will his wife be responsible for the debt he owed before the marriage? If they file a joint federal tax return will the company the judgment is owed to be able to take the refund since the wife did not owe the debt?

No.

Federal tax returns can only be garnished for past due child support or taxes. If this is a civil judgment granted to private company or person, the tax return is safe. The risk is having deposited wages or the tax return moneys siezed from bank accounts. Till the judgment is paid, it would be in your best interest to keep all your financial dealings separate, you don't want any kind of co-mingles funds that could be seized.
