My father in law is in a nursing home. A medical and finicial power of attorny has been appointed. My father in law is also estranged from his family. There has been little or no contact between him and his children for almost 10 years. If the power of attourny dosen't want to complete his tasks, what are the legal obligations of the children. Are they responsiable for any of his debts? Can they be made to become responsiable for his medical care. He is also getting a divorce from his second wife. Who is responsiable for making descisions for this person? All parties concerned live in NC.

Children are NOT legally responsible for the debts of their father UNLESS they have agreed to pay his bills, countersigned, etc.

The share of his estate, if any, they might receive, would be decreased by his bills, of course.

As to the rights and responsibilities of the person holding the power of attorney, that's often dependent on the EXACT wording of the power and here a NC lawyer who read it would have to advise you on that.
