I'm being sued in court over a contract that was assigned to a DJB. The only "parts" of the contract that they are showing (through discovery) are revisions, some of which are after the account was charged-off and assigned to the DJB. If the assignee no longer has the original contract between buyer & seller in their possession, by what right do they have to collect on the "contract"? What chance would they have to collect in court if they can't show the original contract and its terms? They do have the application where I signed, but not the rest of the original contract. Are all contracts, this one being a revolving account, automatically assignable, meaning they don't have to have a provision for this in the original contract itself? If so, what would a normal right to assign look like in a contract? Thanks for your help in understanding.
