Hi...this is an odd one.

I had this guy which I knew from way back call me and ask if his company could rent my apartment for 2 days in order to attend a trade show.

I had the dates available and sent over a short-term rental agreement which spells out the amount, terms, etc. etc. etc. These guys don't return it with their payment and called me the day before telling me that they were coming. I told them they needed to send in their payment and they promised they'll bring it with them (you know how that goes). So they show up and tell me they need to see their boss in the morning to get the money and the guy I know leverages his former relationship with me to let them stay in the apartment and promised me to have the money by morning.

Well...the morning comes, they call me on the phone and ask how much they owe...and I tell them...about $500 + $200 for a security deposit. The guys apparently hadn't read the lease, terms and conditions and scoffed at the amount and since I never got the lease back signed I agreed to a reduced amount of $365 and waived the $200 security deposit. They agreed but said they would only pay with a credit card or I would have to wait till they got back to Ohio and send me a check. Now i'm no Hilton Hotel and told them that it was unexceptable and that they would have to vacate the premises. They said okay we'll get you your money and had me meet them for breakfast...where, you guessed it, no money. To make a long story short, they had me meet them at two other places, only to tell me excuses that a 2 year old would come up with (these guys were all in their 50's) and then ditched me in a taxi cab and raced back into the apartment. Mind you that I had already locked them out for non-payment and they were in the building trying to get in.

I waited outside the building for them to call me and when they did, they started demanding that I come up to the 4th floor and let them into the building, it's now 1 a.m.... Unable to take the abuse, I called the NYPD...who showed up like Al Qaeda was in town and forcibly removed the men, got them to pay me $150, and then escorted them back into the apartment to get their luggage and dropped them off at another hotel somewhere.

My questions are.....

1. I want to sue them for the remaining balance of $215...I really don't care about the money...I just feel its my duty to pursue the matter so they don't do this to someone else...and to also get even with the men for betraying my trust and generally taking advantage of me.

2. I don't want to have to go to Ohio and sue them. I believe that since they committed the act in New York City, that I can use a NY State court....but which one? and how?

3. I called the employee and the owner twice after the fact...the Owner of the company said he will pay the balance...and then the employee (the one I have a history with) writes me a letter telling me he's going to send a letter full of false accusations to the Better Business Bureau unless I dismiss the amount owed and copies his boss (is that considered extortion?)....

Any thoughts or similar experiences would be helpful....please don't tell me to walk away...If it was a stranger I would....

Ok , I won't tell you next time to make sure you get your money upfront by either cash , certified check , or US Postal M/O.

Sue in small claims Court .

small claims is no small potatoes

The occurence happened in New York City and the varmits went back to Ohio....can I sue them in a small claims with jurisdiction in New York since the transgressions occured in New York?....

Yes, if that's where the rental is/was.
