I'm being sued in JP court (non-lawyer judges) for $480.00. After months of going back and forth with the court and the plaintiff I finally got an answer to my bill of particulars. When I added up the charges, they only add up to $139.99, although the plaintiff threw three references to a single $100.00 co-pay in the mix.
My question is. . .
Should I just avoid trial and pay the $480.00? Will a judge look and listen to the fact that the real charges only add up to $139.99? She's claiming the balance is pain and suffering, time waiting in the ER etc. This is a dog bite case, but my dog was on a leash at the time. The animal control officer told me ( didn't write in the report) that she clearly violated his personal space.
